How Is Alimony Determined in North Carolina?
North Carolina courts have a great deal of discretion when it comes to determining alimony. There are no specific guidelines for calculating alimony, as there are for child support. Instead, the court will consider a number of factors when determining the amount and duration of alimony payments.

Some of the factors that the court will consider include:

  • The length of the marriage
  • The standard of living during the marriage
  • The age and health of each spouse
  • The financial resources of each spouse
  • The earning capacity of each spouse
  • The needs of each spouse
  • The marital misconduct of either spouse
It is important to note that the court will not consider marital misconduct if it is the cause of the breakdown of the marriage. For example, if one spouse had an affair and that affair led to the end of the marriage, the court will not consider that affair when determining alimony. However, if one spouse had an affair and the marriage ended for other reasons, the court may consider that affair when determining alimony.
Once the court has determined the amount and duration of alimony, it will issue an alimony order. The alimony order will specify the amount of the payments, the duration of the payments, and the date on which the payments are due. The court may also specify the method of payment, such as a lump sum payment or periodic payments.

Can Alimony Be Modified or Terminated?

Alimony can be modified or terminated if there has been a substantial change in circumstances. For example, if the spouse receiving alimony gets a new job and starts earning a higher income, the court may reduce or terminate the alimony payments. Similarly, if the spouse paying alimony loses his or her job and is unable to find a new job, the court may reduce the alimony payments.

Instead, the court may reduce the alimony payments to reflect the financial support that the spouse is receiving from his or her new partner.
