Alienation of Affection and Criminal Conversation in North Carolina

North Carolina is one of the few states that still recognizes “heart balm” torts, including alienation of affection and criminal conversation. These civil claims allow a spouse to pursue legal action against a third party whose conduct interfered with the marriage and ultimately caused the breakdown of the relationship.

Although these claims can be complex and highly fact-specific, they remain a recognized part of North Carolina law and can result in significant financial damages.

Alienation of Affection

Alienation of affection occurs when a third party intentionally interferes with a marital relationship and is the cause of the loss of love and affection between spouses.

To establish a claim for alienation of affection in North Carolina, a spouse generally must show:

  1. A genuine marriage with love and affection existed.
  2. The love and affection was destroyed or diminished.
  3. The defendant’s wrongful and malicious conduct caused the loss of affection.

Criminal Conversation

Criminal conversation is a separate civil claim that focuses specifically on sexual relations between a married person and someone who is not their spouse.

Unlike alienation of affection, criminal conversation does not require proof that the third party caused the marriage to fail. Instead, the claim generally requires proof of two elements:

  1. A valid marriage existed at the time of the conduct.
  2. Sexual intercourse occurred between the married spouse and the third party.

Because of these elements, criminal conversation claims can sometimes be more straightforward to establish if sufficient evidence exists.

Potential Damages

If successful, a plaintiff may recover monetary damages for the harm caused to the marriage. Damages may include compensation for:

  1. Loss of affection and companionship
  2. Emotional distress
  3. Humiliation and mental suffering
  4. Loss of marital support

In some cases, punitive damages may also be awarded if the conduct was particularly egregious.

Important Timing Considerations

North Carolina law places strict statutes of limitation on these claims. Generally, a lawsuit must be filed within three years of the last wrongful act that contributed to the claim.

In addition, these claims must typically involve conduct that occurred before the spouses separated. Conduct that occurs after separation generally cannot serve as the basis for a claim.

Because timing and evidence are critical, it is important to seek legal advice promptly if you believe you may have a valid claim.
