Requirements for a Valid Separation Agreement in North Carolina
For a separation agreement to be enforceable under North Carolina law, several requirements must be met:
- The spouses must be living separately.
Separation means living in different residences with at least one spouse intending the separation to be permanent. - The agreement must be in writing.
- Both spouses must sign voluntarily.
- The signatures must be notarized.
