What Is a Separation Agreement?

A separation agreement is a written contract between spouses who are living separately. It outlines the terms of their separation and addresses important issues such as:

  2. Spousal support (alimony and postseparation support)
  3. Child custody
  4. Child support
  5. Responsibility for household expenses
  6. Possession of the marital home
  7. Retirement accounts and other assets

In North Carolina, a separation agreement is a legally binding contract once it is properly executed.

Requirements for a Valid Separation Agreement in North Carolina

For a separation agreement to be enforceable under North Carolina law, several requirements must be met:

  1. The spouses must be living separately.
    Separation means living in different residences with at least one spouse intending the separation to be permanent.
  2. The agreement must be in writing.
  3. Both spouses must sign voluntarily.
  4. The signatures must be notarized.

Although there are other factors to consider, if these requirements are met, the agreement becomes a binding contract that can be enforced in court.

What Is Family Law Mediation?

Unlike a judge, the mediator does not make decisions or impose outcomes. Instead, the mediator facilitates productive discussions so the parties themselves can reach an agreement.
Mediation is commonly used to resolve issues such as:

  1. Child custody and parenting schedules
  2. Child support
  3. Spousal support (alimony)
  4. Division of marital property and debt
  5. Post-separation disputes
  6. Modifications to existing agreements or court orders

If the parties reach an agreement, the terms can be written into a binding settlement agreement or consent order and submitted to the court for approval.
