Domestic Violence in North Carolina

Domestic violence is a serious issue that affects individuals and families across North Carolina. The law provides important protections for victims, including court orders designed to prevent further abuse and provide immediate safety. What Is Domestic Violence Under North Carolina Law?

  2. Intentionally causing bodily injury
  3. Placing someone in fear of imminent serious bodily injury
  4. Continued harassment that causes substantial emotional distress
  5. Sexual assault or unwanted sexual contact
  6. Stalking or threatening behavior

A Personal Relationship May Include:

  1. Current or former spouses
  2. Individuals who live together or previously lived together
  3. Parents of a child together
  4. Family members such as parents, children, grandparents, or siblings
  5. Individuals in a dating relationship or who previously dated

If domestic violence occurs within one of these relationships, the victim may seek protection through the courts.

Domestic Violence Protective Orders (DVPO)

Victims of domestic violence in North Carolina can request a Domestic Violence Protective Order (DVPO), commonly known as a “50B Order”, through the court system.

A Protective Order May Provide Important Forms of Relief, Including:

  1. Ordering the abuser to stop threatening, harassing, or assaulting the victim
  2. Requiring the abuser to stay away from the victim’s home, workplace, or school
  3. Granting temporary custody of children
  4. Ordering the abuser to leave a shared residence
  5. Requiring the surrender of firearms and weapons
  6. Providing temporary financial support or possession of property

Protective orders are designed to provide immediate safety and legal protection.

Emergency Ex Parte Protective Orders

In urgent situations, a victim may request an ex parte protective order. This type of order can be issued by a judge without the abuser present if there is a serious and immediate danger of domestic violence.
Ex parte orders typically provide temporary protection until a full court hearing can be held, usually within about 10 days, where both parties have the opportunity to present evidence.

Final Domestic Violence Protective Orders

After a court hearing, a judge may enter a final domestic violence protective order if the court determines that domestic violence occurred. These orders may remain in effect for up to one year, though they may be renewed in certain circumstances.
Violating a domestic violence protective order is a criminal offense and may result in arrest and additional penalties.

Domestic Violence and Child Custody

Domestic violence can significantly affect child custody and visitation decisions. North Carolina courts prioritize the best interests and safety of the child when determining custody arrangements.
If domestic violence has occurred, the court may:

  1. Limit or supervise visitation
  2. Restrict contact between the abusive parent and the child
  3. Consider the abuse when determining custody and parenting plans
